Mississippi state law recognizes twelve legal grounds for divorce. These include adultery, bigamy, a wife’s extramarital pregnancy, habitual cruel and inhumane treatment, habitual drunkenness, habitual drug use, desertion, imprisonment for more than one year, natural impotency, incest, an official diagnosis of insanity or an institutionalization for insanity.

When a spouse files for a divorce under one of these legal grounds, a judge determines the details of their case. The key elements of the court’s order (including asset division, spousal maintenance, and child support and custody) are based on factors that include: the relative income of each spouse, the children’s best interest and other factors as set forth in Mississippi case law.
